Terms of Service

1. Not a Licensed Therapy Service

2. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent that you are 18 or older and have the legal capacity to enter into these Terms.

3. Account Registration

You agree to provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately at hello@melanvow.app if you suspect unauthorized access.

4. Subscription Plans & Billing

Free plan: Provides 2 lifetime sessions at no cost.

Paid plans: Core ($29/mo), Voice ($59/mo), and Enterprise ($199+/mo) plans are billed monthly via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

Cancellation: You may cancel at any time through the billing portal. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial months except where required by applicable law.

Price changes: We will provide at least 30 days notice before changing subscription prices. Continued use after the effective date constitutes acceptance of the new price.

5. Acceptable Use

You agree not to:

• Use the Service to harass, abuse, or harm others
• Attempt to reverse-engineer, scrape, or extract data from the Service
• Share your account credentials with others
• Use the Service for any unlawful purpose
• Impersonate any person or entity
• Upload malicious code or attempt to interfere with the Service's infrastructure
• Use the Service as a substitute for emergency mental health services

6. Your Content

You retain ownership of the content you submit through the Service (session messages, profile information, etc.). By using the Service, you grant us a limited license to process your content solely to provide the Service. We do not use your content to train AI models or for advertising.

7. AI Limitations

The AI counselor may produce inaccurate, incomplete, or inappropriate responses. You acknowledge that:

• AI responses are not guaranteed to be accurate or appropriate for your situation
• The AI does not have memory between sessions unless you explicitly provide prior context
• AI-generated advice should not replace professional legal, financial, or therapeutic guidance
• We are not liable for decisions you make based on AI responses

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MELANVOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Fulton County, Georgia.

12. Changes to Terms

We may update these Terms periodically. We will notify you of material changes by email or in-app notice at least 14 days before changes take effect. Continued use after the effective date constitutes acceptance.
